Diamond District & Commercialization within Residential Complexes

What should be the extent of commercial activity inside a  Residential Complex? Should it be decided by the Builder who is managing the complex, or the Owners Association? The Diamond District Apartment Owners Welfare Assocprint_image.phpiation is quite clear about its stand.

On Saturday when a 150 strong movie crew descended on the lawns of Diamond District, the Residents had to bring in the Police to get the crew out!

Times of India reports the incident:

Chaos reigned at the Diamond District apartment complex on Old Airport Road after a 150-member film crew landed at the plush complex to shoot for ‘Prema Purana’.

Diamond District was chosen as one of the locations for shooting the Kannada film starring Nithin, Radhika Gandhi, Shraddha Dey and others. Producers Gajanana Film hadn’t obtained police permission for shooting in the complex.

The war of words between residents and the film crew came to halt only after police intervened and chased away the crew.

Diamond District residents, who have been opposing commercialization of serviced apartments, claimed that frequent film shoots in the vicinity were disturbing their peace. The shoot for this movie had been on in a serviced apartment for about a week now. But on Saturday, the scene shifted to the lawn, drawing the ire of residents.

THE GROUSE
Diamond District occupants complained that no permission was obtained from the Diamond District Apartment Owners Welfare Association (DDAOWA) and police before the shoot.

Reacting to the charges, movie director Shivakumar R said: “We have a permission letter from Century Galaxy Developers Ltd (CDGL) for shooting on this premises and we have been paying charges too. We must get a refund.”

During heated arguments between police and crew, Old Airport police station inspector Venkatashetty sought to know from the CDGL spokesperson as to why the film crew didn’t seek permission from residents.

“Movie-makers have now been allowed to come and shoot films here. The maintenance managers behave as if they are absolute owners of Diamond District. They earn Rs 30,000 per day to give permission for such activities. This is nothing but intrusion on our privacy,” said Raja Nambiar, president of DDAOWA.

Residents have now lodged a complaint in the Old Airport police station. “We don’t allow any commercial activity on our premises. We are the owners of the apartment. Why should the CDGL give permission to film makers without our consent?” questioned apartment dwellers. “With over 400 workers employed in the 230-odd serviced apartments here, we have been facing security threats of sorts. It’s unsafe for women and children,” they said.

LOOKING UP TO LOKAYUKTA
DDAOWA members recently met higher education minister Aravind Limbavali and BBMP commissioner Siddaiah against commercialization of residential apartment complexes. “We’ll ask the Lokayukta to come to our rescue. We want him to intervene and get us sale deeds for our apartments, ” Nambiar said.

FinMin refuses to remove Service Tax

As per the Economic Times today, the Finance Ministry has refused to withdraw the Service Tax imposed on construction 223811_newspaperprojects in the Real Estate Sector.

ET reports further:

The Budget for 2010-11 proposed a service tax of 2.5 per cent on all under-construction projects in the real estate sector. The Urban Development Ministry, however, wanted to get the tax revoked on the plea that the sector was still to recover from the economic slowdown which it witnessed two years ago.

Urban Development Minister S Jaipal Reddy had on April 15 met Finance Minister Pranab Mukherjee and sought the removal of the service tax.

In the meeting, Reddy had said that the sector was going through a difficult phase and the service tax could hurt its interests as also that of the middle class families.

Sources in the Urban Development Ministry said that the proposal has not been accepted as the ground situation in the sector had changed since the request was first made.

“It has been observed that in the last four months or so there has been an upswing in the realty sector and it has overcome recession successfully,” an official said.

The service tax of 2.5 per cent on the actual sale value will be imposed on all under-construction projects from this month.

As the developers are not expected to absorb the new tax, they would pass it on to the consumers leading to an increase in costs of apartments all over the country, which would hurt the consumers directly, the sources said.

Associations helping in Khata Registration

It is an open secret in Bangalore that for Khata registration or transfer, Bribe is one of the line items of the unseen Invoice.

Addressing a gathering of 200 Suncity residents, Mr Satish Reddy congratulated the association office bearers on undergoing the process of legally obtaining khata without bribing anyone. He offered the residents to come forward and contact him for any issues concerning various Government departments in his constituency.
Although the journey was long to reach to this milestone and it took nearly 6 months but Kudos to our office bearers Kashinath Prabhu (Secretary), Vidyasagar Magdum (Treasurer), Chander hass Banotra (Vice-President) and our senior citizens especially Mr Ashok Kumar Dube for doing wonderful job on publicity, organizing camp for common documents, helping BBMP in arranging documents, visiting BBMP office minimum once every week and persistent follow ups.”

Association under Karnataka Apartment Ownership Act

Our Users have frequently requested for a set of Information / Documents that is typically required while registering an Association under the Karnataka Apartment Owners Act – 1972.

Below is the list.

1. Year of Construction of the Apartment Building.
2. Sanction Plans, Approval Plans and Occupancy Certificate of the Apartment Building.
3. No-Objection Certificates from Local Bodies.
4. Sale Deed/s of the Land on which the Apartment Building exists.
5. No. of Owners/Occupants in the Apartment Building and a few Sale Deeds of such owners.
6. Prospective name of the Apartment Association/Society.

Armed with the above information a Meeting can be held to elect the first Office Bearers. The Minutes of the Meeting can also note that By-Laws have been drawn, which will be authorized during the Registration process.

Service Tax Refund for Apartment Owners

Construction of Residential Complex was brought under service tax w.e.f. 01.06.2005 and there was no ambiguity among the stake-holders at the operational level- “Any service provided or to be provided to any person, by any other person, in relation to construction of a complex is classified as Construction of Residential Service and is liable for appropriate Service Tax, as applicable.

But with the issue of the Circular 108/2009-ST dt. 29.01.2009, which states that construction of residential complex is in the nature of self-service and hence service tax is not applicable, all the stakeholders at the field level have started interpreting and giving different meaning, resulting in ambiguity, chaos & uncertainty.

However, in layman’s terms, the following points emerge on a detailed understanding & analysis of the said Circular:

1. Applicability of the Ciruclar: The Circular is applicable to all unit owners within a residential complex, who have paid service tax to their respective builders as part of the total cost of the unit.

2. Eligibility of Owners: Out of the above, only those owners are eligible for refund of service tax who have registered the property with the full value i.e. the construction cost plus share of undivided portion of land meaning that the owner did not have any rights in the unit until the execution of the Sale Deed.

3. Cut-off date for applying for Refund: The cut-off date for applying for service tax refund u/s 11B of the Central Excise Act,1944 is 1 year from the relevant date. Now,as per this section, the relevant date is the date of payment of service tax. Most of us must have paid this tax long back.Hence, it looks like our application would be time-barred.But, the Circular came only in 2009. The relevant date might be 1 year from the date of the circular as per another interpretation. So,to take the benefit of doubt,it makes sense to apply for refund within 29.01.2010 to stand a chance of getting it.

4. Two Refund options:

(i) If the builder has collected the service tax from the owners but not remitted to the Govt., then we have to take the refund from the builder itself.

(ii) If the builder has collected the service tax and remitted it to the Govt., then the question of applying to Govt. arises. The application should be in Form-R and accompanied by the following documents:

a.Copies of Agreement to Sell,Construction Agreement & the Sale Deed.

b.Certificate from the builder stating the amount of service tax paid for each unit owner as well as the proof of payment.Now, getting these is not as easy as it sounds. If one is unable to get these in the time frame, it makes sense to collect the client ledger copy showing the collection of service tax.Refund

While there is no absolute surety of refund, without applying there is no chance of refund. The law will take its own course and definitely the Board would be seized of the matter and take appropriate action to dispel the doubts for the benefit of the common man and also to augment the legitimate Service Tax due to the exchequer from this major potential service.

Registration of Apartment Owners Association

DocumentationWe have been receiving many questions related to the procedure for registering Apartment Owners Association / Home Owners Association in Karnataka, under the Karnataka Societies Registration Act – 1960 . Here are the answers.

To get the Association Registered before the Registrar of Societies the following  documents are to be prepared:

1. Proposal letter addressed to the Registrar of Societies for formation of Association duly signed by the Executive Committee Members.
2. Name of the Association.
3. Address of the Association.
4. Proceedings of the First General Body Meeting
5. Memorandum of Association
6. List of Governing Body/Executive Committee Members, with their passport size photographs.
7. Bye Laws (Rules & Regulations)

All the above documents to be prepared in Kannada for purpose of Registration.

The approximate expenses for purpose of Registration (legal help inclusive) will be around Rs.15,000 to Rs.18,000.
